Trump DOJ Claims Banned CNN, Politico and MS NOW «Threatened National Security» as Legal Battle Intensifies

The Justice Department is formally defending Trump’s decision to ban CNN, Politico and MS NOW from White House grounds. Government lawyers argue that «access to the White House is a privilege—not a right» and say the President can restrict organizations that allegedly fail to meet professional standards required for journalists entering sensitive areas of the presidential complex.

The DOJ’s defense goes considerably further than complaints about unfavorable coverage. White House letters accuse the three organizations of «trafficking in verifiable falsehoods about national security and other issues, and publishing sensitive or classified information.» These are serious allegations made by the administration as part of its legal defense, not findings that have been established by a court.

When Trump announced the restrictions on September 18, his explanation focused heavily on what he considered dishonest reporting. On Truth Social, Trump accused the organizations of spreading «FICTION and LIES» and described their coverage as «a threat to our National Security, and must be stopped, NOW!» Their journalists subsequently lost their White House hard passes.

The government’s court filing provides more specific allegations, citing reporting concerning U.S. ammunition supplies during the war with Iran and information involving White House construction and security infrastructure. «The President has found that Plaintiffs have engaged in a number of reporting incidents that have threatened national security,» the DOJ argued while defending Trump’s decision to exclude them.

CNN, Politico and MS NOW responded by jointly suing the Trump administration and seeking emergency restoration of their White House access. Their lawsuit calls the restrictions a «direct assault on the First Amendment» and argues that journalists cannot legally be punished because government officials dislike their reporting. The organizations also allege violations of constitutional due-process protections.

The dispute is now before U.S. District Judge Timothy Kelly. The DOJ argues that the President has broad discretion over access to sensitive White House spaces, «even for viewpoint-discriminatory reasons.» The outlets counter that allowing such retaliation would give the government enormous power to determine which journalists can directly cover the President based on their reporting.

The confrontation quickly affected presidential coverage. CNN was scheduled to provide shared television pool coverage, but after it was excluded, ABC, CBS, NBC and Fox News declined to replace the network. Their decision effectively suspended the usual television pool system, which provides cameras, microphones and other equipment when every news organization cannot independently attend presidential events.

The consequences became obvious during Trump’s outdoor unveiling of a new White House helipad. Without the normal television pool equipment, the administration relied on its own feed as helicopter noise overwhelmed the President’s remarks. A pool report noted that the reporter «couldn’t hear what he said over the sound of the helicopter,» illustrating the logistical importance of independent broadcast crews.

The dispute followed Trump to the United Nations, where White House restrictions did not control press credentials. CNN’s Kaitlan Collins asked when the war with Iran would end. Trump responded, «I’m surprised that CNN is here covering me. You should not be here covering me. You said you weren’t going to cover me. You shouldn’t be covering me.»

Collins immediately answered, «The United Nations allowed us in, sir.» Trump did not answer her question about the war and instead moved on. CNN had not stopped covering Trump; major television networks had suspended their shared White House pool duties following CNN’s exclusion, creating a distinction between boycotting the pool system and abandoning coverage of the President.

Trump later attacked Collins again on Truth Social, asking, «Then why were they ranting and raving like Lunatics, in the Press Area, at the United Nations? Why was she there?» He continued, «She’s got a “TRUMP” addiction, and so does CNN and MSDNC. They’re all sick, treasonous, and demented!» The broader constitutional dispute now remains before Kelly.
